Lawyers representing Los Angeles Councilman Mark Ridley-Thomas filed a motion March 19 opposing the government’s request that they disclose their witness list.
Ridley-Thomas’ filing alleges there is no law requiring they disclose their witness list, as the government is required to do, and are asking Judge Dale Fischer to deny the government’s request.
“There is constitutional justification for treating the disclosure of government and defense witness lists differently because the government has the burden of proof.”
“The court prefers that defense counsel email witness and exhibit lists to the chambers email box by noon the Monday before the trial, but counsel are not required to do so unless these witness names and exhibits have previously been provided to the government.”
Judge Fischer is expected to issue his ruling when court resumes on March 21 at 7:45 a.m.
